Caitlyn Jenner will not be charged in fatal crash

Prosecutors declined to charge Caitlyn Jenner on Wednesday in a California car crash that led to the death of another driver, saying there was not enough evidence for a conviction.

Authorities said Jenner was towing an off-road vehicle on a trailer behind a Cadillac Escalade on Feb. 7 when she crashed into two cars, pushing one into oncoming traffic. Driver Kim Howe was killed when her Lexus was hit by a Hummer.
“We believed from the start that a thorough and objective investigation would clear Caitlyn of any criminal wrongdoing,” said Blair Berk, Jenner’s attorney.
“We are heartened the district attorney has agreed that even a misdemeanor charge would be inappropriate. A traffic accident, however devastating and heartbreaking when a life is lost, is not necessarily a criminal matter.”

The D.A. rejected the case, saying she was not speeding, she hit the brakes though belatedly, and her conduct was not "unreasonable" based on all the facts.

Photos: Mother kills her newborn baby by tossing her out of her 7th floor apartment

Jennifer Berry, 33, tossed her newborn baby out the window of her seventh-floor apartment window after delivering it in the shower, on Monday, September 28, police and prosecutors said. The former child welfare worker has been charged with second-degree murder and manslaughter after an autopsy determined the death was a homicide caused by multiple blunt-force trauma. The baby’s father was in the apartment when the killing occurred, but police sources said Giovanni Johnson, 28, knew nothing about Berry’s bizarre behavior.

"I didn’t know about the pregnancy," a rattled Johnson told The News by phone Tuesday, his voice cracking. "I didn’t know any of this. I’ve been cleared of all charges."

Johnson told police Berry had been pregnant months ago, but she told him she had had an abortion, according to sources.

Neighbors rallied behind Johnson, who grew up on W. 183rd St. and has a 3-year-old boy with another woman. Berry, who lives in Yonkers, started showing up at the apartment about a year ago, they said.
"I don’t think he knew," 27-year-old Tiffany Martinez said of Johnson. "He looked as surprised as anybody else. He looked shocked."

When cops showed up at the building, Johnson was outside talking to Martinez and didn’t have an inkling about what happened, she said.

Horrified neighbors found the newborn’s remains in the building courtyard around 2:30 p.m. and called police.
"I saw the blood ... when you went up the stairs you could see everything," said Bolton’s wife, Janiqua Torres, 33.
"When I heard the police say ‘baby,’ that’s what crushed me. It was that serious, it crushed me," Torres added.

Bolton said Berry refused to go with police until cops kicked the door in. The mother initially denied she was pregnant before confessing that she gave birth in the shower of her apartment Monday afternoon, according to police sources.

She claimed the newborn wasn’t breathing and she threw the baby, as well as the placenta, out the window, the sources said.
But at Berry’s arraignment Tuesday night in Bronx criminal court, Assistant District Attorney Georgia Barker flatly denied it.

"She gave birth to an 8-pound girl and dropped the newborn seven stories to the pavement. The medical examiner has determined that the baby was alive," Barker told the judge as an impassive Berry stood by in grimy gray sweatpants and a darker gray hoodie.
"There was air in the lungs, this was a healthy baby girl," Barker said.

Berry was remanded without bail. She next appears in court Oct. 5.

84 Senators pass confidence vote on Saraki amid rows

SenateThe Nigerian senate on resumption of plenary after its annual recess on Tuesday, 29th September, 2015 passed a Vote on Confidence on its incumbent leadership led by the Senate President, Dr. Abubakar Bukola Saraki.
The Senators had in a motion moved by Senator David Umaru who represents Niger East Senatorial District, seconded by former governor of Zamfara State and Senator representing Zamfara Central Senatorial District, Senator Ahmed Sani and overwhelmingly supported by 82 others, passed the Vote of Confidence.
It however did not go without a little hitch as a Senator from Osun East, Babajide Omoworare who chairs the Senate Committee on Rules and Business raised that he would like to withdraw his name from the list and Senator Kabiru Marafa disrupting proceedings till he walked out of the Floor while Senators debated the motion which was subsequently passed with the overwhelming support of Senators present

This is an improvement in the performance ratings of the Senate leadership as about 81 Senators had earlier done such a few months ago with Senators rising beyond their political affiliations to support the leadership of Senator Bukola Saraki without a dissenting voice.

Champions League: Arsenal, Chelsea beaten, Barcelona produce fine comeback

Arsenal and Chelsea continued England’s poor start to this season’s UEFA Champions League, after they both lost on Match Day 2.
The Gunners, who were beaten 2-0 at Dinamo Zagreb, needed all three points to get their campaign on. But Felipe Pardo opened scoring for Olympiacos in the 33rd minute. Theo Walcott equalized for the home side, but David Ospina fumbled the ball into his own net, to gift the Greeks a half-time lead.
Alexis Sanchez equalized for Arsenal again, but one minute later, they allowed Alfred Finnbogason slide in the winner. Arsene Wenger’s men are now bottom of Group F with zero points

Jose Mourinho did not enjoy a good return to FC Porto, as his Chelsea team lost 2-1.

FG receives last batch of Ebola Rescue Mission team

The Federal Ministry of Health on Tuesday received the last batch of Nigeria’s Ebola rescue teams from Sierra Leone and Liberia.
The permanent Secretary of the ministry, Mr Linus Awute, while receiving the delegation in Abuja, welcomed the members of the teams and said the country was happy that all who went for the mission came back safe and sound.
Awute, was represented by Dr Sani Gwarzo, Director, Port Health Services, on behalf of the ministry and Nigeria Centre for Disease control.

He, however, said that members of the teams would be under health observation for few days.
He said that out of 204 persons who went on the mission to Sierra-Leone and Liberia, 188 returned in May, seven came back on Monday, and five returned on Tuesday.
Awute said two people each from the teams would remain in Sierra Leone and Liberia to round off the assignment.
“The 12 that have arrived are all healthy but we must, under scientific protocol, give them a thorough screening, both for other health conditions and Ebola

“The contributions of Nigeria cannot be quantified in these countries; it has been very substantial in many forms.
“At the time Nigerians contributed to the work force, many countries were scared that they will get exposed but Nigeria took the lead which opened the minds of others to contribute,’’ he said.
Mr Womi Eteng, the Operation Coordinator in Sierra Leone, said when the team went there, the country was recording an average of 300 cases of Ebola daily.
He said at their departure, the cases had reduced to less than 10, adding that it was important for a health worker to support other countries to save lives.
The “Nigerian Government gave their support and made sure we had all that was needed, so, fear was the last thing on my mind,’’ Eteng said.
Ahmed Gawar, one of the public health officers in Liberia, said that it was not easy in the beginning but with the zeal to save lives, they worked with everything and anything to achieve success.
“Nigeria is a great nation and it shows its strength whenever the need arises,” Gawar said.
He said that Federal Government gave them all the support they needed to succeed in the mission.
“They supported us with all their strength by responding to calls and requests without any delay,’’ he said. (NAN)

Falae: abductors vowed to grab me again if I talk

Falae: abductors vowed to grab me again if I talk
‘I was let go day after ransom
was collected’

A former Secretary to the Federal Government (SGF), Chief Olu Falae, said yesterday that he paid ransom to his abductors before his release last week.
He provided shocking details of how he was starved, made to trek kilometres and forced to sleep on leaves while it rained.

The former presidential candidate said he was kidnapped on his birthday by six Fulani herdsmen last Monday at his Ilado farm on the outskirts of Akure, the Ondo State capital.
Speaking to reporters at his home in Akure, Falae said the armed hoodlums threatened to kill him every 30 minutes, until they received information that the ransom had been paid. He did not state how much was paid to the abductors, who initially asked for N100 million, which they reduced to N90 million. A family member said they could raise only N2 million.

Falae, 77, said: “There were six of them with three or four guns and every half an hour or so they will say, ‘Baba we are going to kill you, if you don’t give us money we are going to kill you.
“On Wednesday, one of them said we are leaving here on Thursday morning. Since we cannot leave you here alone, if we don’t get what we want we are going to kill you.
“And they said they gave me until 3pm. I thank God that at 21 minutes before 3pm, one of them came and said ‘the money don complete’.”

Reliving his ordeal, he said: “When the hoodlums came, they slashed me with their cutlasses, they said I was not cooperating. And they dragged me barefooted into the bush.
“After dragging me around for about two hours, they stopped somewhere for us to rest and there they asked me to phone my wife and tell her that I have been kidnapped and taken out of Ondo State, which was a lie.

“About 2.30pm on Monday, we started walking with very few stops until 2am the following morning. I guess I must have covered a minimum of 15 kilometers.
“That morning, I did not take anything. So all day, I had no food, no water and I walked close to 15km. How I survived I cannot really remember. I had no food in my stomach, I had no shoes, my clothes were torn.

“At a point, one of them gave me a pair of slippers. Later, they called for a motorcycle. The motorcyclist took me away. I had no clue where we were going. Finally, they dumped me somewhere, where I was, until I was released on Thursday.
“In that place, we all slept on leaves. Unfortunately, it rained in the night and I was drenched. One of them brought a small umbrella to cover my head, but the rest of my body was not.
“They offered me bread, but I told them I could not eat it. I demanded for a bottle of coke, which was what I drank every day to have energy and to continue with the march, because we were always moving.

“They were changing locations two to three times a day. I suspect it was to prevent the police from tracing them.”
The ex-finance minister said although the confirmation of the payment of ransom was made on Wednesday afternoon, he was not allowed to go until Thursday morning.
“So the following morning, they said I should go. One of them took ropes to stitch my buba, which was tattered.

“So when I came out of the bush, I found a motorcyclist, who gave me a lift to Owo.
“The place was about 10km from Owo town. The place was between Owo and Ifon. And I walked to that place. I guess we must have trekked about 25km.
“Miraculously, I was not tired, I was not hungry and I was not afraid of them at all. Each time they said, ‘Baba we will kill you,’ I will tell them, ‘no, insha Allah, you will not kill me’.
“I did not break down, but I want to tell you that when I got back home I became completely exhausted.

“But I am now 80 per cent fit and I know in the next few days I will be 100 per cent again.”
The 77-year-old warned that such attack should not be allowed to happen again as it could result to even graver consequences.
“It is not because of me. As for me, I am a very humble person, but by virtue of what God has made me and the status He has given me, it is an insult to our race that a man like me could be abducted by a bunch of hoodlums.”

He added: “By the way, one of them told me ‘Baba, if after you leave us you talk nonsense I will come and catch you again’. That is the kind of insult I received.”
Asked if the kidnappers were illiterates, Falae replied: “Only two of them could speak some English. They were between 25 and 35. They were Fulani but they spoke Hausa.”
Falae said it was likely his ordeal was closely connected to his conflict with Fulani herdsmen, who consistently grazed on his farm.

“The cattle rearers have been giving me a hard time for the past two or three years. Because I have a dam on the farm, so they like to bring their cattle there to drink water, then they eat my crops.
“This time they ate up my maize farm. We took pictures, and it was videoed, the police went there. They were asked to pay compensation, they begged and paid half and we accepted it.
“That was about two months ago. Whether it was one of them who went to bring his brothers to come and deal ‘with this wicked man’, I don’t know. It is plausible.
“My view is that this is my home. I have not gone to farm on anyone’s territory. This is my home where I was born. I have every right to farm here and live in peace here. So, this is totally unacceptable.

“I once told the commissioner of police that if he cannot protect us and protect my farm, then I will protect myself. There will be self-help, if government fails to protect its citizens.
“It would have been unfortunate if that were to happen. The IG met me and assured me that they will give us protection.

“I hope that we  in Ondo State and in Yoruba land would consult to ensure that we enhance our protection. We cannot be slaves in our own territory.”
The former SGF said he was not surprised that the police could not trace and arrest the kidnappers because of the manner of their movement and operation.

“These fellows were permanently on the move. Day and night they were walking. Through farm lands, through water, through swamps…they were scared, they knew they could be traced with GPS, that was why they were running around all the time.
“I was not surprised at all that the police could not trace them before they decided to let me go.”

52-year-old man kills nephew, snatches his lover

shockA 52-year-old man, Obert Dube, from the Jobe Village under Chief Bangwe in Mberengwa Clan, Zimbabwe, has allegedly hung his nephew, identified as Benefit, to death over the deceased’s lover, saying he (Benefit), was too young to date the said unnamed lover.
NewsdzeZimbabwe reports that Dube, who wanted to snatch his nephew’s girlfriend, beat the poor man to death before reportedly hanging his body on a tree outside his yard in a bid to conceal the crime.
He was said to have fled to South Africa after committing the alleged crime in an attempt to evade arrest. However, he was reportedly arrested a few days ago and appeared before Mberengwa Chief Magistrate, Mr Christopher Maturure, facing murder charges as defined in Section 47 of the Criminal Law (Codification and Reform) Act, Chapter 9.23.

Dube’s charges read in parts: “The State’s case is that on 13 August this year Dube killed his nephew, Benefit Dube, following a misunderstanding over a woman and he went into hiding.
“On the fateful day the court heard, Dube and Benefit were drinking beer at Jobe Shopping Centre when the latter’s girlfriend came to visit him. It is alleged that the uncle was not happy about it and he confronted Benefit. He ordered him to leave the woman alone as he was too young to date her, insinuating that he was the one suitable for her.
“The court also heard that a heated argument ensued and Benefit left the shopping centre with his girlfriend. At about 8p.m the same day, Benefit went to visit his uncle at his homestead where a misunderstanding arose over the same issue, resulting in the latter assaulting the former with fists.
“Dube allegedly hit Benefit on his left cheek below the ear and he fell to the ground and became unconscious. Dube immediately rendered first aid on his nephew and he regained consciousness.

“The following morning, Dube woke up at around 5am to go and check on Benefit but found him dead just outside his yard.
“Dube allegedly took a chain from his yoke and hanged Benefit’s body on a tree a few metres from his homestead and fled the scene to evade arrest.
“The matter was reported to the police who visited the scene and Benefit’s body was taken to Msume Hospital for a post-mortem. Dube was later arrested after police got a tip off from members of the public.”
Reports further reveal he was asked not to to plead and was remanded in custody.
The Magistrate, who was represented by Mr Hebert Tafa of Tafa and Associates, reportedly advised Dube to apply for bail at the High Court.
